Terms of Service

Effective September 9, 2026

These Terms of Service (“Terms”) govern your access to and use of Mutualish, including our website, email notifications, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use Mutualish.

1. Eligibility and age requirement

Mutualish is only for people who are at least 18 years old. By creating or using an account, requesting verification, submitting an interest, viewing a match, or otherwise using the Service, you represent and warrant that you are 18 or older and legally able to enter into these Terms. Mutualish is not intended for minors. If we learn that an account belongs to a person under 18, we may suspend the account and delete associated information.

2. What Mutualish does

Mutualish lets adults privately indicate interest in people they already know. A non-mutual interest is not revealed to the person who was added. If two verified users independently add each other, Mutualish may reveal the mutual match to those two users. Mutualish may also send a discreet invitation telling a recipient that someone they know added them, without identifying the sender.

Mutualish does not verify romantic intent, relationship status, personal compatibility, or the identity of a person beyond the account and email-verification steps we provide. A match only means that two accounts independently submitted each other’s email addresses through the Service.

3. Your account and information

You are responsible for providing accurate information and maintaining control of the email account you use with Mutualish. You may only submit an email address when you reasonably believe it belongs to a real person you know or have a legitimate personal reason to contact through Mutualish. You may not impersonate another person, create accounts for someone else without authorization, or use misleading information to manipulate the matching process.

4. Respectful use

Mutualish is designed for private, consensual discovery, not harassment. You may not use the Service to threaten, intimidate, stalk, shame, discriminate against, defraud, exploit, or repeatedly contact someone who has indicated they do not want Mutualish invitations. You may not use scripts, bots, bulk lists, scraped data, purchased lists, or other automated means to send invitations or submit interests at scale. You may not interfere with the Service, attempt to bypass rate limits or privacy controls, probe for another person’s private interests, or misuse invitation or match links.

5. Privacy and confidentiality of interests

We designed Mutualish so that non-mutual interests are not intentionally revealed through the normal product experience. However, no online service can guarantee absolute confidentiality or security. You should only submit information you are comfortable entrusting to an online service. Our collection and use of personal information is described in the Privacy Policy.

6. Invitations, email, and opt-out

When you add someone, Mutualish may send that person an invitation email. The invitation is designed not to identify you. Recipients can opt out of future invitation emails, and we may suppress delivery to addresses that opt out, bounce, complain, or otherwise should not receive further invitations. Verification, security, account, and mutual-match messages may be treated differently from invitation emails where permitted by law.

7. Safety and personal responsibility

Mutualish is not a dating agency, background-check service, identity-verification service, emergency service, or safety service. You are responsible for your own communications, decisions, meetings, and interactions with other people. Use good judgment, respect boundaries, and do not rely on Mutualish as proof that another person is safe, available, single, or interested in any particular relationship or activity.

8. Beta service; changes and availability

Mutualish may be offered as an early-stage or beta service. Features may change, break, be delayed, or be discontinued. We may modify, suspend, limit, or discontinue all or part of the Service at any time, including to protect users, maintain security, comply with law, or improve the product. We do not guarantee uninterrupted availability, delivery of every email, preservation of every item of data, or that every match will be detected or communicated without error.

9. Suspension and termination

We may investigate suspected misuse and may limit, suspend, or terminate access to Mutualish if we reasonably believe a user has violated these Terms, created risk for another person, abused invitations or email delivery, attempted to defeat privacy or security protections, or exposed Mutualish or others to legal or operational risk. You may stop using Mutualish at any time and may use our Privacy Controls page or contact us to request deletion of your account or associated personal information, subject to legal, security, fraud-prevention, and operational retention requirements.

10. Intellectual property

Mutualish, including its software, branding, design, text, logos, and product features, is owned by or licensed to the operator of Mutualish and is protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. They do not transfer ownership of Mutualish or its intellectual property to you.

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, AVAILABILITY, OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUTUALISH AND ITS OPERATOR, AFFILIATES, SERVICE PROVIDERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REPUTATION, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF MUTUALISH AND THE PARTIES DESCRIBED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MUTUALISH FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $100. These limitations apply only to the extent permitted by applicable law and do not limit liability that cannot legally be limited.

13. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mutualish and its operator, affiliates, service providers, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, your infringement of another person’s rights, or information you submit in violation of these Terms. This section does not require you to indemnify a party for that party’s own unlawful conduct where prohibited by law.

14. Changes to these Terms

We may update these Terms as Mutualish evolves. If a change is material, we may provide notice through the Service or require you to affirmatively accept the updated version before continuing to use certain features. The effective date above identifies the current version.

15. General terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. We may assign these Terms in connection with a reorganization, financing, merger, acquisition, sale of assets, or transfer of the Service. Applicable law governs these Terms, including any consumer protections that cannot be waived by contract.

16. Contact

Questions about these Terms, account deletion, abuse, or the Service may be sent to hello@mail.mutualish.com.
